Booking Terms & Conditions

These booking terms and conditions set out your agreement with Fortune Education Pty. Ltd. and apply to the Events and Courses for which you have registered for by way of signing registration agreement, to the exclusion of all other terms and conditions issued or stipulated by any other party other than Fortune Education Pty. Ltd.

In these terms and conditions, all references to “us”, “our” and “we” means Fortune Education Pty. Ltd. and all Events and Courses will be known as “the Event/Course” and all references to the “website” mean: www.fortuneeducation.com.au

You are fully aware that the Events/Courses presented constitutes “information only”, does not take into account your personal situation or needs and therefore does not constitute any form of personal advice of any kind. We recommend that you do your own research regarding the information presented and seek professional advice that suits your own personal circumstances before acting upon any of the information presented. These terms & conditions may change from time to time and you may always find the most current version on our website.

Definitions:

“Event” means a live introductory seminar that is promoted and facilitated by Fortune Education Pty. Ltd.

“Course” means a live program that takes place over one or more days for which attendees pay registration fees to attend and which is facilitated by Fortune Education Pty. Ltd.

Rescheduling your Registration for a Course

If for any reason you are unable to attend the course that you’ve registered for, you must notify Fortune Education Pty Ltd at least 30 days prior to the scheduled course start date by emailing: events@fortuneeducation.com.au. If a subsequent course is available, you may transfer your registration to a later course without penalty, provided that your attendance is within 1 year of the date of this agreement.

If your request to transfer to a later course is made within 30 days of your original scheduled course start date, an AU $300 administration fee will apply in addition to your agreed course registration fee.

You are permitted one transfer only from your original course registration date. Requests for more than one course transfer or non-attendance to the course you’ve registered for, will result in 100% forfeiture of your monies paid without any further obligation from us to provide any services to you in relation to this agreement. If no subsequent course is available, you may transfer your monies paid towards another program facilitated by Fortune Education Pty Ltd within 12 months from your date of registration.

Transferring your Registration to another Attendee

If you cannot attend the Course for which you have registered, your ticket is transferable to another person, provided that you supply us with the full contact details of your substitute person at least thirty (30) days before the Course and provided that this person notifies us via email their acceptance of your transfer to events@fortuneeducation.com.au. Once the transfer has taken place, the transferee will be bound by the same terms & conditions as you – the original Course ticket holder.

Deposit & Payments for Course Registrations

We will not deem that you have registered for a course until such time as we receive a payment from you equal to or greater than the minimum deposit required for the course for which you are registering for.

If you elect to complete payment with a payment plan, we will process payment to your nominated credit card on the dates specified and in the amounts on your signed registration form.

Payment for your course services outlined on your agreement must be completed no later than 14 days prior to the start date of the event.

If for any reason your payment does not process or declines on the agreed scheduled payment dates, we will contact you once by email to notify you of this and request payment by alternative means. If either; we don’t receive payment from you within 7 days of the payment decline, or you do not contact us to make alternative arrangements, your registration will be cancelled and you will forfeit your monies paid to that point and there will be no obligation from us to provide any services to you in relation to your agreement.

Course Rescheduling and Cancellation

Fortune Education Pty Ltd reserves the right to reschedule or cancel any event if we feel it is necessary and in the best interest for both parties (You, the attendee, and Fortune Education Pty Ltd), this includes instances of Force Majeure. Changes to a course include program dates, audience capacity, venue, speaker or hours. In such circumstances when course changes or rescheduling is required by Fortune Education Pty Ltd, you retain the right to reschedule your registration in accordance with our rescheduling policy.

We will notify you in writing no later than 30 days before the event is due to begin, except for Force Majeure, unusual or unforeseen circumstances outside Fortune Education Pty Ltd control. In which case, we will enrol you into the next course. Monies paid will not be refundable and Fortune Education Pty Ltd will not be held liable for any compensation.

Course Registration Cancellation

If you choose to cancel your enrolment for a course for any reason other than within any applicable cooling-off period, or in accordance with any state or federal law, we will maintain a credit in your favour for the total amount you have paid for use towards the same course within 12 months of your registration date. If attendance to the course is not exercised by you within this time, you will forfeit your monies paid and you will no further claim against us. Refunds are not available for any of the Fortune Education Pty Ltd online programs.

Money Back Guarantee

If the course you have registered for and are attending has been offered with a money back guarantee, your entitlement to a refund of your monies paid must be exercised in person by you by no later than 5pm on the second date of the course for 3 day programs, or no later then 5pm on the first date of the course for 2 day programs. You must return all of your course materials and a refund of your course fee will be paid by us to you within 7 days. The Money Back Guarantee can only be exercised by attending the specified amount of days stated on your signed registration agreement and by no other means. The money back guarantee refund is not applicable to any of the Fortune Education Pty Ltd online programs.

Cooling Off Period

Within 7 days of payment of your registration deposit, you may at any time, notify us via email to: events@fortuneeducation.com.au that you wish to cancel your registration. If you do so, we will refund to you the total amount you have paid to us for your course registration, excluding the value of bonus products you may have received during registration, within 7 days of Fortune Education Pty Ltd receiving such written notice. Refunds are not available for any of the Fortune Education Pty Ltd online programs.

Intellectual Property

By providing you with products, materials and the information in the presentation of the Event or Course, no transfer of title to you is made with respect to any of the applicable Intellectual Property rights for those items. As such, you may not:

(a) Copy or reproduce any of the content of the products, materials, Event or Course or record them by audio, visual or audio-visual means, in any format, or

(b) on-sell the products, materials or intellectual property or make them available for public viewing or hire, to or by any third party.

You authorise us to use any digital, film or other recording of your participation in the Course for any purpose, at our discretion, including without limitation, in connection with the marketing and promotion of Event services and concede that we shall have sole right to the intellectual property therein.

Limitation of Liability

Fortune Education does not accept liability for any accident, injury or loss suffered while attending any Event or Course except in respect of death or personal injury resulting from any act or omission on the part of the supplier.

We: (a) exclude all terms, conditions and warranties implied by custom, the general law or statute or which may cause any part of these Terms or Conditions to be void or voidable; (b) limit our liability to you on any account whatsoever to the total amount actually paid by you to us to receive the Event or Course; (c) limit our liability to you for any claim (whether arising in contract, tort or statute, for loss or damage suffered by you, connected with or relating to the performance of the Event or Course your attendance at the Event or Course, to the total amount actually paid by you to us, to receive the Event or Course; and (d) exclude all liability for consequential damage (including but not limited to, lost revenue or lost profit) suffered by you in any way connected to the Event or Course or your exercise of rights under these Terms and Conditions.

Personal Well-being

At all times you are responsible for your own mental, emotional and physical well-being. You warrant that you are able to judge what Courses or activities are suitable for you. You acknowledge that we are not aware of any conditions you may have or any circumstances you are faced with, and you hold us to be without any blame for any mental, physical, emotional or financial loss, damage or harm that arises from your attendance to any of our Events or Courses.

Disclosure

We reserve the right to pay commissions to any third parties that may be associated in your entering into this agreement with us.

General

The laws of Australia govern this agreement and you agree to submit to the exclusive jurisdiction of the Australian Courts.

Death

Where the Attendee passes away, a death certificate must be provided to process a refund. A refund may be provided per the following:

Death occurs prior to the event
More than 45 days – full refund of monies received, less a 10% administration fee.
Less than 45 days – full refund of monies received, less 30% administration fee.
Death occurs during the event

We do NOT refund any monies received once the event has commenced, due to financial commitments to the event. The Attendee’s emergency contact person assumes all responsibility of the emergency process as soon as our team has contacted them. Your nominated emergency contact must agree to these terms, therefore we strongly recommend providing him/her with a copy of our course Terms and Conditions.
